While Jon Gosselin may not be allowed to speak, unfortunately his lawyer still can.

Never one to shy away from publicity, Gosselin's lawyer Mark Heller insists that Homewrecking Hailey Glassman "is going to jail. It's as simple as that."

Someone's not jumping to conclusions or anything!

According to the douche's lawyer, police have seized the building's security tape which Heller says "will not lie and the evidence will speak for itself."

And while the homewrecker's team has said this whole break in was a publicity stunt, one source says Hailey, who is the only other person with a key to the apartment, has already admitted she wrote the note.

Inneresting.

But the best comment we've yet to hear is this little gem from Mark Heller's mouth, and we quote: "Jon feels like he was raped."

A bit much, don't ya think?
