It's hard to know what's going on in your ex's life, especially if there isn't a real Gossip Girl to clue you in.

But Kelly Rutherford found another way - a private investigator!

Kelly has some major issues with her soon to be douchebag of an ex-husband, civilian Daniel Giersch, and how he takes care of their 2 year old son at his home. Kelly sent her spy to observe, specifically if he covers the pool while it isn't in use, preventing the young one from any fatal accidents.

He doesn't.

Idiot!

She brought the matter to court and the court made an official ruling that Giersch must keep his pool covered at all times when not in use.

Next big issue?

Potty training!

Is it too stressful for the kid to start while the parents are in the midst of their divorce?

And then after that will be the ever so much fun discussion of custody for the boy and his soon-to-be baby sister. Rutherford is due to give birth in three weeks with the couple's second child.

What a mess!

We think you should just reconcile. It would easier!
